'Mask Pack Trademark' dispute won
“Brand Reliability rather than
Sales & Packaging"
Medical beauty group Banobagi won the lawsuit over mask pack trademark rights.
According to the industry on July 14, 63 of the Seoul Central District Court,
Civil agreement, Part 63 (Chief Prosecuting Attorney Park Wonkyu)
company A filed a claim that 'BANOBAGI' can't use the design
applied to the mask pack and pay 150 million won
and the claimed plaintiffs veridcted to lost.
BANOBAGI is a brand named after four specialists
who founded Banobagi Plastic Surgery in 2000.
Since 2015, BANOBAGI has introduced Derma Cosmetics products.
A company signed a trademark license agreement with Banobagi
and distributes the Banobagi mask pack.
After the 2017 contract has ended.
However, they manufactured and sold a mask pack
with a similar design in a package called 'BNBG'.
In the market, as the BANOBAGI and BNBG mask packs were distributed together,
it was recognized that the BANOBAGI mask pack was a pre-renewal product
or a similar product (aka fake).
The company filed a lawsuit with the intention that the Banobagi mask pack design
was developed by the company.
However, the court did not accept A's claim that
there were many similar designs already at the time of product launch
and that Banobagi participated in the design planning stage.
Banobagi's claim that the sales of the BANOBAGI brand's mask packs
depended on the brand reliability built up from the hospital
rather than the packaging design.
Meanwhile, Banobagi is expanding its influence to foreign countries
such as Thailand, Vietnam, Hong Kong, Russia & etc.
by introducing new products such as jelly masks in June of last year.
In Vietnam, the company recently launched three types of vitagenic jelly masks.
From January next year, the company will participate in a program
aired by the Vietnamese broadcaster VTV2 and introduce products.
